We are looking for crafters, creators, makers, food truck and liquor vendors to join us for our 3rd annual Georgian Bay Festival in Tiny Township

The park is located just minutes from Wastage Beach, Elmvale and Woodland Beach.

KEY DETAILS FOR THE 3RD ANNUAL FESTIVAL

  • Date: Saturday, August 19, 2023, 11 AM – 8 PM
  • Vendor check-in: 7 AM – 10:15 AM
  • Cost: 20′ X 20′ space starting at 100$ (tents, tables and chairs are not included in the cost and are the sole responsibility of the vendors)
  • Vendor registration is limited to vendors that make or create their product
  • The marketplace is limited to 80 vendors

IMPORTANT DATES

  • JUNE 30 – Payment due
  • AUG 15 – Final cancellation date with refund – No refunds after this date
  • AUG 15 – Food vendors must have their paperwork submitted to the Simcoe Muskoka District Health Unit (SMDHU)

VENDOR RULES AND REGULATIONS

ADMISSION TO THE FESTIVAL

Any person wishing to have a stall and/or table at the festival must submit the online Vendor Intake form and be accepted by the festival. The Festival Committee may, in their discretion, approve or deny any application and shall provide the applicant with an explanation for any refusals. No Vendor may set up unless fees have been paid and a valid proof of insurance provided to the festival organizers.

SITE ALLOCATION

  1. All Vendors are to provide their own 10’ x 10’ tent(s) if needed.
  2. All vendors must respect their stall space and not interfere with walkways, customer access to neighbouring stalls or the flow of customers throughout the market.
  3. Vendors must keep their stall space and surrounding area clean and remove all debris at the end of the day. Festival garbage containers are for the convenience of customers only. Vendors must take their garbage home with them at the end of the day.
  4. All tents must be safely secured. Vendors may not set up a tent if not securely anchored.

SIGNAGE

  1. Vendors must have a sign identifying their business name and location.
  2. Signage must remain within a reasonable area outside of their stall. Please do not impede a clear walking path.
  3. Sandwich boards may not protrude beyond 18” from the front edge of the tent.

ATTENDANCE

  1. Vendors are expected to arrive in a timely fashion. Set up must be complete by 10:45 am.
  2. All vendors must be in attendance and remain set up for the full duration of the day.
  3. There can be no early knock-down or departure before the end of the day, except where dictated by extreme weather conditions or by permission of the Festival Manager.

CANCELLATIONS

Please email us by Aug 15th so that your space can be reassigned. No refunds after Aug 16th.

HOLD HARMLESS AGREEMENT

By paying for vendor space, you agree that you, your family, business, farm, club, or organization will be responsible for its own security at all times while in attendance at the Georgian Bay Festival Market. You indemnify and hold harmless the Georgian Bay Festival, the board of directors and representatives, and the Georgian Bay Park and its representatives from any damage, loss, or theft to you, your representative(s) or your property during your participation at the Georgian Bay Festival Market.

You further agree to accept sole liability for the consequences, legal or otherwise, of any injury or loss to persons, whether vendors or market visitors; or any injury, damage, or loss to the property of vendors or market visitors; that results from your failure to properly guard and secure your tent, or which results from your failure to guard and secure any other item constituting your setup or display or possessions; and you, therefore, indemnify and hold harmless from all claims the Georgian Bay Festival Market and the boards of directors and representatives, and Georgian Bay Park and its representatives.

CODE OF CONDUCT

The Georgian Bay Festival Market provides a dynamic opportunity for the sale of local farm produce, food products and artisan products. The primary purpose of the Code of Conduct is to ensure the market environment is enjoyable, safe and secure for the public, vendors, and all market participants.

As a vendor of the Georgian Bay Festival Market, I will:

  • Conduct myself in a courteous and respectful manner towards the public and all market participants;
  • Comply with all Health Department rules and regulations and observe provincial and federal food legislation;
  • Refrain from using language which is offensive, threatening or intimidating to others and/or any behaviour that interferes with the rights or working/selling opportunities of other vendors;
  • Refrain from participating in the market under the influence of alcohol or drugs;
  • Operate vehicles or equipment in a safe and responsible manner;
  • Follow a no-smoking policy;
  • Respect and adhere to the Rules and Regulations established by the Georgian Bay Festival Market.

A report of failure to comply with any component of the Code of Conduct or the Rules and Regulations will be assessed and investigated by the Market Manager.

REVOCATION OF VENDOR STATUS

All vendors must adhere to the Vendor Code of Conduct. Anyone who fails to do so maybe asked to leave the event immediately. Fees will not be reimbursed to a Vendor whose status has been revoked.

PHOTO RELEASE AGREEMENT

This document confirms the agreement between you and the Georgian Bay Festival regarding your participation in approved Festival activities in which you may be photographed or videotaped (the Property) from time to time.

You hereby irrevocably grant the Georgian Bay Festival perpetually, exclusively, and for all media throughout the world (including print, film, slides, non-theatrical, home video, CD-ROM, internet and any other electronic medium presently in existence or invented in the future), the right to use and incorporate (alone or together with other materials), in whole or in part, photographs or video footage taken of you as a result of your participation in approved activities of the Georgian Bay Festival.

The Georgian Bay Festival or its designee shall have complete ownership of the Property in which you appear, including copyright interests, and you acknowledge that you have no interest or ownership in the Property or its copyright. The Property will be provided to media outlets for their unrestricted use, indefinitely. The Georgian Bay Festival does not have control of the material once it is disseminated. This grant includes the right to use the Property for promoting or publicizing any of the uses.

You hereby agree that you will not bring or consent to others bringing claim or action against the Georgian Bay Festival on the grounds that anything contained in the Property, or in the advertising and publicity used in connection herewith, is defamatory, reflects adversely on you, violates any other right whatsoever, including without limitation, rights of privacy and publicity. You hereby release the Georgian Bay Festival, its staff and executive, successors and assigns from and against any and all claims, demands, actions, causes of actions, suits, costs, expenses, liabilities and damages whatsoever that you may hereafter have against the Georgian Bay Festival in connection with the Property.

This agreement shall not obligate the Georgian Bay Festival to use the Property or to use any of the rights granted hereunder, or to prepare, produce, exhibit, distribute or exploit the Property.

The Georgian Bay Festival shall have the right to assign its rights hereunder, without your consent, in whole or in part, to any person, firm or corporation.

VOLUNTEER ASSUMPTION OF RISK, WAIVER OF LIABILITY AND WAIVER FORM

PLEASE READ THE FOLLOWING VERY CAREFULLY — THE FOLLOWING AFFECTS YOUR LEGAL RIGHTS.
  1. No pay, payment, salary, wage or employee benefits (such as accident/ disability/medical/dental or other insurance coverage) whatsoever will be paid to me and I will not be covered by Workplace Safety Insurance Board coverage.
  2. I acknowledge that performing volunteer activities may involve certain elements of risk or the chance of an accident, or exposure to infectious diseases and I am waiving my legal right to sue the Festival, and its officers, employees and agents and their respective successors, assigns, heirs, and executors including in respect to negligence, negligent misrepresentation, breach of statutory duty (including the Occupiers’ Liability Act) and breach of contract for any harm or damage to physical property or personal injury of any nature whatsoever.
  3. I release the Festival, and its officers, employees and agents and their respective successors, assigns, heirs, and executors from all claims for loss, damage, or injury.
  4. I have reviewed the Festival’s relevant policies and will abide by all of the Festival’s policies and rules as may be amended from time to time, and will follow all instructions of the appropriate Festival supervisors in carrying out the volunteer activities.
  5. I will not use facilities, equipment and property owned by the Festival without the approval of a Festival supervisor, and will not use them for personal purposes.
  6. I will immediately notify the appropriate Festival supervisor of any incident that involves property damage or personal injury during my volunteer duties.
  7. I attest that I will not volunteer if I experience any symptoms of COVID-19 or if I come into contact with someone who may have COVID 19. If I develop these symptoms I will notify the Festival.
  8. I will abide by the COVID 19 guidelines set out by the Public Health Agency of Canada and the Simcoe Muskoka District Health Unit as they relate to preventing the spread of COVID-19 including physical & social distancing protocol.

I acknowledge that I have read and understood the preceding conditions, release, and waiver; and I agree to the preceding conditions, release, and waiver.

VOLUNTEER / RELEASE AND AGREEMENT

I authorize the Georgian Bay Festival to collect personal information appropriate to the position applied for concerning my academic background and employment/volunteering history. I give permission to the Georgian Bay Festival to obtain, if required, a criminal record check and/or driver’s abstract. I understand that I will be advised in advance if a criminal record check and/or driver’s abstract is required. I understand that if I am less than 18 years of age, I must have my parent/guardian sign and provide their contact information. I understand that the information obtained will be confidential but may be shared with relevant organizations in order to obtain an appropriate volunteer position. I certify that the information is true and complete to the best of my knowledge. I understand that a false statement may disqualify me from further consideration as a volunteer or result in dismissal. I agree to behave in accordance with the Fundamental Principles of the Georgian Bay Festival. Please Note: Some positions require a satisfactory Criminal Record Check. Should a Criminal Records Check reveal information which raises concerns relevant to your volunteer role and/or is contrary to your oral and/or written representations, the Georgian Bay Festival reserves the right to restrict or terminate your involvement with the Georgian Bay Festival.

I have reviewed and understand the Volunteer / Release and Agreement form and understand that a complete form is to be signed prior to the Festival permitting my involvement in a volunteer activity. In accordance with the Municipal Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c.M.56, personal information is collected as necessary for the proper administration of a lawfully authorized activity, i.e. to determine the suitability of the applicant for a volunteer position with the Festival, and will be used only for the purposes of determining eligibility of volunteers. By submitting this form, I hereby acknowledge that this form will become the property of the Georgian Bay Festival.
